Purpose of construction permit

Construction permit facilitates organizations, households or individuals to carry out construction projects in the fastest and most convenient way. This permit is also used as a basis for construction supervision, handling of violations during construction, preparation of completion records and registration of ownership or use of the project.

Construction permit application documents

A construction permit application document set includes:

– Application for construction permit

– Copy of documents proving land use rights (or file containing original photo)

– Copy of technical drawings approved in accordance with the provisions of the Construction Law, including: construction site plan on the land plot 1/50 – 1/500 with attached construction site location diagram; drawings of floor plans, elevations and vertical sections of the construction at scale 1/50 – 1/200; foundation plan drawing at scale 1/50 – 1/200 and foundation cross-section at scale 1/50 with attached diagram of rainwater drainage, wastewater treatment, water supply, electricity supply, information at scale 1/50 – 1/200).

Design drawings are a mandatory part of the building permit application.

– Copy or file of the original document approving the investor’s foundation construction method to ensure safety for the project and neighboring projects (for projects with basements).

– Commitment to ensure safety for adjacent projects by the investor (applicable to projects with adjacent projects).

Procedures for submitting application for construction permit

– Step 1: Submit the application to the urban management office of the People’s Committee where the house is being built and the construction permit is being requested.

– Step 2: The application receiving department will check the application. If the application is incomplete, it will request additional information. If it is complete, a receipt will be issued to the land user.

– Step 3: The land user will go to the application receiving office according to the time stated in the receipt to receive the results according to regulations.

The application processing time is from 21-30 days from the date of receiving a complete and valid application. During this period, the land user will be granted a preliminary permit to complete the house construction design documents.

The construction permit fee will vary depending on the area and scale of construction.
